Principles of processing and protection of personal data

The privacy and security of the processing of personal data is very important to us. We process your personal data in accordance with applicable law and ensure its protection to the maximum extent possible.

I.
Basic provisions
  1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) is NFI, s.r.o. IČO 52 640 019 with registered office at Jánošíkovo nábrežie 1212/2, 031 01 Liptovský Mikuláš, Slovenkso, registered in the Commercial Register kept by the District Court of Žilina, Section: Sro, Entry No.: 73182/L (hereinafter referred to as: “the Administrator”).

Personal data is any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, a network identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  4. The controller has not appointed a special data protection officer. The responsible persons are the managing directors of the company.
II.
Sources and categories of personal data processed

The controller processes personal data that you have provided to the controller or personal data that the controller has obtained on the basis of the fulfilment of your order:

Visiting the website – information from visitors

  • IP address,
  • Cookie ID, browser type and version, type of device used to access the website,
  • browser type and version,
  • the type of device used to access the website.

The controller processes your identification, contact and contract data.

III.
Lawful basis and purpose for processing personal data
  1. The lawful reason for processing personal data is:
    • the performance of the contract between you and the controller pursuant to Article 6(1)(b) GDPR,
    • compliance with the controller’s legal obligation under Article 6(1)(c) of the GDPR,
    • the legitimate interest of the controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
    • Your consent to processing for the purposes of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in the event that no order for goods or services has been placed.
  2. The purpose of processing personal data is:
    • processing your order and exercising the rights and obligations arising from the contractual relationship between you and the administrator; when placing an order, personal data are required that are necessary for the successful processing of the order (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or to perform it by the administrator,
    • fulfilling legal obligations to the state,
    • sending commercial communications and carrying out other marketing activities.
  3. There is no automatic individual decision-making on the part of the controller within the meaning of Article 22 GDPR.
IV.
Data retention period
  1. The controller stores personal data
    • for the period necessary for the exercise of the rights and obligations arising from the contractual relationship between you and the controller and the exercise of claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
    • for as long as consent to the processing of personal data for marketing purposes is withdrawn, up to a maximum of 15 years if the personal data is processed on the basis of consent.
  2. After the expiry of the retention period, the controller shall delete the personal data.
V.
Recipients of personal data (subcontractors of the controller)
  1. Recipients of personal data are persons
    • involved in the delivery of goods/services/making payments under the contract,
    • providing marketing services.
  2. The controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organisation.
VI.
Processors of personal data

The processing of personal data is carried out by the controller, but personal data may also be processed for the controller by the following processors:

  • Webmail service provider (https://mail136.websupport.sk),
  • Zoom it s.r.o., Hviezdoslavova 3, 821 06 Bratislava, ID : 35930888
  • possibly another provider of processing software services and applications, but which are not currently used by the administrator.
VII.
Your rights
  1. Under the terms of the GDPR, you have
    • the right of access to your personal data under Article 15 GDPR,
    • the right to rectification of personal data pursuant to Article 16 GDPR or restriction of processing pursuant to Article 18 GDPR,
    • the right to erasure of personal data pursuant to Article 17 GDPR,
    • the right to object to processing pursuant to Article 21 GDPR,
    • the right to data portability under Article 20 of the GDPR; and
    • the right to withdraw consent to processing in writing or electronically to the address or e-mail of the controller referred to in Article III of these Terms and Conditions.
  2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to take legal action.
VIII.
Privacy Policy
  1. The controller declares that it has taken all appropriate technical and organisational measures to safeguard personal data.
  2. The controller has taken technical measures to secure the data stores, in particular the access password, the data provided pursuant to point I and the e-mail communication.
  3. The controller declares that only persons authorised by it have access to the personal data.
IX.
Final Provisions
  1. By completing the online registration form on our website (www.nfidiet.sk), you confirm that you are aware of the privacy policy and that you accept it in its entirety.
  2. You agree to these terms and conditions by checking the consent box via the online registration form. By checking the consent box, you confirm that you are aware of the privacy policy and that you accept it in full.
  3. The Administrator is entitled to change these conditions. It will post the new version of the Privacy Policy on its website and will also send the new version of the Privacy Policy to you at the email address you have provided to the Controller.

These terms and conditions come into force on 07.01.2019.
